Terms and conditions of purchase
The Terms and Conditions of Purchase were last updated on 21 September 2022.
General provisions
- These Terms and Conditions of Sale and Purchase of Goods (hereinafter referred to as the "Terms and Conditions") are a binding legal document which sets out the rights, obligations, conditions for the purchase, payment and return of Goods and other provisions relating to the purchase, sale and sale of goods on the website www.nevartyk.lt between the two parties (the Buyer and Seller).
- Before placing an order, the Buyer confirms that he/she has read, understood and accepts the rules for the purchase of the goods described.
- The Seller shall have the right to change, amend or supplement the Terms and Conditions in accordance with the requirements set out in the legislation of the Republic of Lithuania.
- The Buyer will be informed of any changes to the Terms and Conditions by logging into the e-shop (www.nevartyk.lt).
The moment of conclusion of the contract between the Seller and the Buyer
- You may purchase goods from nevartyk.lt in the following ways:
- After selecting the goods in the online shop, add them to the "shopping cart" and continue ordering online.

- The contract between the Buyer and the Seller shall be deemed to have been concluded from the moment that:
- The Buyer places an order in the e-shop, specifies the necessary data for the conclusion of the contract and for the delivery of the goods, and clicks on the "Make payment" button;
- When placing an order by telephone or e-mail, the Buyer shall provide the necessary data for the conclusion of the contract and the delivery of the goods;
- Information on all orders from www.nevartyk.lt e-shop is stored in the Nevartyk database
Protection of personal data
- In order to successfully complete the order, the Buyer must provide the correct data on the website www.nevartyk.lt during the registration process.
- The Buyer is responsible for the correctness of the data provided during registration.

- The Seller undertakes confidentiality with regard to the Buyer's personal data, except in the cases provided for by the law of the Republic of Lithuania.
Rights and obligations of the Buyer
- The Buyer has the right to purchase goods in the e-shop, in accordance with the rules of purchase and sale of goods and in accordance with the procedures set out in the other information sections of the e-shop.

- The Buyer undertakes to accept the ordered goods and to pay the price stipulated in the sales contract.
- The Buyer shall have the right to return the goods in accordance with Order No 258 of the Minister of Economy of the Republic of Lithuania of 17 August 2001 on the approval of the rules governing the sale of goods and the provision of services in the case of contracts concluded by means of communication.
- The buyer must state the reason for which he wishes to return the goods in writing.
- The goods may be returned only if they have not been damaged, used or substantially altered in appearance.
- The Buyer wishing to return the Goods to the Seller must return the Goods in their complete condition. If not all parts of the complete set meet the requirements set out in Clause 4.6 of the Conditions, the Seller shall have the right not to accept the returned goods.
- If the Buyer's details on the registration form change, the Buyer must update them as soon as possible.
- The Buyer accepts the Terms and Conditions before placing the order and undertakes to comply with them and not to violate the legislation of the Republic of Lithuania.
Rights and obligations of the Buyer
- The Seller undertakes to facilitate the Buyer's use of the services provided by www.nevartyk.lt.
- If the Buyer attempts to undermine the stability and security of the online shop or violates his/her obligations, the Seller shall have the right to restrict, suspend or terminate the Buyer's access to the online shop immediately and without prior notice.
- The Seller has the right to suspend or terminate the operation of the Online Shop. In such case, all accepted and confirmed orders of the Buyer shall be terminated and no new orders shall be accepted.
- The Seller undertakes to deliver the goods ordered by the Buyer to the address indicated.
- The Seller undertakes to respect the Buyer's right to privacy with regard to the personal information provided in the registration form and not to disclose it to any third party.
- The Seller shall have the right, at its discretion, to set a minimum amount above which free delivery of the order will be made. The amount of this sum is specified in the delivery conditions.
- In the event of the Seller being unable to deliver the goods to the Buyer due to important unforeseen circumstances, the Seller undertakes to provide an analogous or similar product, which, if the Buyer refuses, the Seller undertakes to refund the money for the goods within three working days, provided that prepayment has been made.
- In the event that the Buyer's rights and obligations under Clauses 4.- 6.of the Conditions are satisfied, the Seller undertakes to refund the amount paid for the returned goods within 14 days from the date of receipt of the goods.
Procedure and terms of payment for goods
- The following methods of payment are available for goods purchased in our online shop:
- Cash (pay on delivery or at the time of arrival at the shop);
- Bank transfer;
- Cash on delivery;
- Electronic Banking.

- The price of the product may not change after the Seller has confirmed the order, unless the price of the product has changed due to technical errors in the information systems or other reasons beyond the Seller's control. If the Buyer does not agree to purchase the product at the new price in such a situation, the Buyer shall have the right to cancel the order by informing the Seller within two working days. If this is done, the Buyer shall be refunded the amount paid.
- If the Buyer purchases a gift voucher which has not been used within the time limit set in the voucher, the voucher shall be deemed to have been used.
Delivery of goods
- For a basket of goods amounting to EUR 10 or more, the Seller or its authorised person will deliver the goods free of charge to the address indicated or to the LP express or Omniva post office of your choice. For a basket of goods under EUR 10, delivery to the address indicated will cost EUR 3, and delivery to the post office of LP express will cost EUR 5.
- The Buyer undertakes to specify the exact delivery address when selecting the delivery service at the time of ordering.
- The Buyer undertakes to collect the ordered goods himself. If the Buyer or the person indicated at the time of ordering as the person who will collect the parcel is unable to accept the parcel, but it has been delivered to the address indicated, the Buyer shall not have the right to make any claim against the Seller in respect of the delivery of the goods to the wrong person.
- The goods shall be delivered by a person authorised by the Seller or by the Seller itself.
- Delivery of the Goods shall take between 1 and 3 days once they are in stock. Delivery may take 2-7 working days if the Goods are out of stock, except in individual cases where the Goods cannot reach the Buyer in time due to circumstances unforeseen by the Seller. In such cases, the Seller undertakes to contact the Buyer personally to arrange a delivery date.
- The Seller shall be exempt from liability for failure to meet the delivery deadlines if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer's fault or due to circumstances beyond the Seller's control.
- At the time of delivery of the goods, the Buyer shall inspect the condition of the goods received and sign the delivery and acceptance document together with the Seller or a person authorised by the Seller to deliver the parcel. If the Buyer notices any damage to the packaging or the goods, or any manufacturing defect or non-conformity of the delivery, the Buyer must immediately inform the Seller.
Guarantee of the quality of the goods and the period of suitability for use
- The characteristics of the Goods sold in the online shop www.nevartyk.lt are indicated in general terms in the description attached to each Good.
- The Seller shall not be liable if the colour, shape or other parameters of the goods in the shop do not correspond to the actual characteristics of the goods due to the resolution of the display used by the Buyer and other characteristics.
- For certain goods, the Seller gives a certain time limit indicating how long the goods can be considered to be of good quality. This shall be indicated in the descriptions of these goods.
- The Seller's guarantee of quality does not limit or restrict the rights of consumers under the law in the event of the purchase of a product or service of inferior quality.
- The Seller does not provide after-sales service for the goods and shall refer the Buyer to the centre providing after-sales service on a case-by-case basis. The Seller may advise the Buyer on the maintenance of the goods and on the rectification of faults.
Return and replacement procedures
- Returns and exchanges of goods shall be carried out in accordance with the 'Rules for the Return and Exchange of Goods', approved by Order No 217 of the Minister of the Economy of 29 June 2001, and the 'Rules for the Sale of Goods and the Provision of Services in the case of Contracts Concluded by means of Communications', approved by Order No 258 of the Minister of the Economy of 17 August 2001.
- Pursuant to the Rules on the Return and Exchange of Goods, approved by Order No 217 of 29 June 2001 of the Minister of Economy of the Republic of Lithuania 'On the Approval of the Rules on the Return and Exchange of Goods', the goods shall be returned to the Seller, defects in the goods sold shall be rectified, and low-quality goods shall be exchanged for high-quality ones.
- A written request for the return of goods is required.
- The following conditions must be complied with when the Buyer returns the goods:
- The returned goods must be in their original packaging in good condition (this does not apply to returns of low quality goods);
- The goods must not have been damaged by the Buyer;
- The goods must not have been used and must not have lost their merchantable appearance (labels intact, protective film not torn off, etc.) (this point does not apply in the case of returns of low-quality goods);
- The returned goods must be in the same condition as when received by the Buyer;
- When returning the goods, the document of purchase and a written request for return must be provided.
- The Buyer wishing to return the Goods to the Seller must return the Goods in accordance with the requirements set out in Clause 4. of the Rules. Otherwise, the Seller has the right not to accept the returned goods.
- The money for the goods returned to the Seller shall be credited to the payer's bank account.
Responsibilities of the Buyer and the Seller
- The Buyer is responsible for the actions he/she has carried out in the online shop.
- The Buyer is responsible for the accuracy of the personal data provided. The Seller shall not be liable for the consequences of incorrectly entered Buyer's data and shall be entitled to claim direct damages from the Buyer.
- Should the Buyer fail to acquaint himself with the Terms and Conditions of Sale and Purchase, even though he has been given the opportunity to do so, the Seller shall be exempt from any liability in the event of any loss resulting from the Buyer's ignorance of these Terms and Conditions.
- The Seller is not responsible for the information published on the pages of other companies, organisations or individuals linked to the website www.nevartyk.lt. www.nevartyk.lt.
- The Seller shall not be liable for the smooth performance of obligations between the Buyer and the Seller's partners whose services are ordered by the Buyer.
- In the event of problems resulting in damages, the party at fault shall indemnify the party not at fault for direct damages.
Final provisions
- These Terms and Conditions are drawn up in accordance with the legislation of the Republic of Lithuania.
- The law of the Republic of Lithuania shall apply to relations arising under these Terms and Conditions.
- Any disagreements arising from the performance of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement within twenty calendar days, disputes shall be settled in accordance with the procedure laid down by the laws of the Republic of Lithuania."
